  • In Nebraska employees have many rights that they may not understand. For example, employees are entitled to receive payment for unused vacation time if the employee manual so provides .  You can read more about your rights as an employee on the Nebraska Department of Labor's website here
  • In Omaha there is an ordinance which prohibits employment discrimination and retaliation against persons based upon their sexual orientation and gender identity. This ordinance applies to employers within the City of Omaha and applies to employers who employee six or more employees in the Omaha area, employment agencies and labor organizations. (enacted in 2012)
  • If you are entitled to FMLA benefits in Nebraska and your employer refuses to allow you to use the unpaid leave, you should contact the Madathil Law Office. 
  • You may be entitled to damages if you have been harassed by a supervisor and it caused emotional or physical damages to you.

      • Plaintiff was a member of a protected class (of a minority race, sex);
      • Plaintiff was subjected to adverse terms, conditions or privileges or employment (or application process).
      • An applicant and/or employee (who was not a member of a protected class) was treated in a more favorable manner in their application and/or terms, conditions or privileges of employment.
