Many employers require that employees get approval prior to working more than forty hours in a week in Employee Manuals. Employers may want to limit the amount of overtime they have to pay. However, if an employee does not get approval prior to working overtime (more than 40 hours in a work week) employers are still required to pay the overtime. The problem arises when an employer refuses to pay an employee for non-approved overtime. The Fair Labor Standards Act (the "FLSA") does not distinguish between approved and non-approved overtime—if the employee works the overtime, employers are required to pay time and one-half the regular rate for that overtime. But the company is not without recourse: An employee who violates a company policy by working non-approved overtime can be disciplined or terminated for that violation of policy.
